Flood Risk Is Now a Design Requirement, Not an Afterthought

For developers and their drainage consultants, flood risk management has shifted from a planning consideration to a mandatory design requirement. The introduction of Schedule 3 of the Flood and Water Management Act 2010 — now enacted in Wales and under active implementation in England — means that sustainable drainage systems (SuDS) are required for most new developments, with local authority approval needed before construction can begin.

At the same time, Approved Document H and the wider suite of building regulations place clear obligations on developers to ensure that drainage systems do not cause flooding to buildings or adjacent land. For sites in flood risk zones, or those with complex drainage catchments, demonstrating adequate backflow prevention is often a specific planning condition.

Why New Builds Still Need Backflow Protection

A common misconception is that new drainage systems, designed to current standards, automatically eliminate backflow risk. In practice, several factors mean even well-designed new drainage can still be vulnerable:

  • Connection to existing combined sewers — if the new development drains to an existing combined or foul sewer with limited capacity, surcharge events upstream can drive backflow into the new system
  • Low-lying finished floor levels — sites designed with below-ground habitable space or utility areas are inherently vulnerable unless the drainage design specifically addresses this
  • Attenuation storage connected to outfall systems — where attenuation tanks drain to watercourses or sewers, a tidal or surcharge event can reverse flow into the attenuation system and ultimately into properties
  • Adoption timescales — during the period between practical completion and sewer adoption by the water company, the developer retains responsibility for any flooding incidents

Where WaStop® Fits Into a New Development Drainage Design

The WaStop® Inline Check Valve is well suited to new development drainage because it can be incorporated at the design stage with minimal cost or complexity. Typical installation points in a new development include:

  • At the curtilage connection — where the development drainage connects to the adoptable sewer, preventing surcharge pressure entering the site
  • On individual plot connections — particularly for apartments, basement car parks or any habitable below-ground space
  • On attenuation tank outlets — preventing tidal or surcharge water from entering the attenuation system in reverse
  • On undercroft or basement drainage connections — commercial developments with underground car parks or plant rooms benefit from point-of-connection protection

Because the WaStop® fits inside the pipe barrel without structural modification, it can be incorporated into standard drainage designs with no additional civil works beyond ensuring appropriate access chamber dimensions.
